THIS AGREEMENT IS MADE FOR THE BENEFIT OF BOTH THE BUYER AND SELLER.

I also understand *

Seller warrants to the best of his or her knowledge that the above-described animal is clean, in good health, and of “pet quality”, at the time that buyer takes deliver and assumes ownership. Reasonable care has been continually exercised to prevent or eliminate parasites and/or skin and/or other problems and/or diseases. However, since these minor issues are completely common among most all animal, Seller does not guarantee that the animal is 100% free of parasites or skin issues at the time of delivery of the animal. Seller assumes no responsibility(ies) whatever after animal leaves the seller’s premises other than what is specifically indicated herein this agreement. Buyer promises, among other things, to provide animal with proper shelter, a loving environment, plenty of food and water, as well as proper, timely, and normal medical care.

I Understand *

To activate the health and other guarantees here, Seller requires Buyer to have a licensed veterinarian examine the animal within 72 (seventy-two) hours* of delivery of animal from Seller (not including Sundays and National Holidays.) Should that licensed veterinarian declare that this animal is in unacceptable life- threatening health, Breeder has the right to get and pay for a second licensed veterinarian opinion. If both veterinarians agree, the animal, all papers, and all other items transmitted during sale are returned to Seller within 24 hours of such written declarations by said licensed veterinarians. Seller will refund full purchase price or exchange the animal for another animal of same or less value based on original purchase price, when one is available from Seller. *Note: If the animal is not examined by a licensed veterinarian within the stated 72 hours after delivery, then no health guarantee is offered or implied herein and Seller is 100% immediately and fully released by Buyer from any and all health conditions and guarantees. In addition, Seller does not assume, bear, or agree to pay any veterinarian or other costs and/or bills(s) for any purpose at any time whatsoever concerning this animal now and/or in the future. After the initial 72 hours, to activate and use this 2 year only guarantee unless otherwise noted, a written statement from the veterinarian on veterinarian’s clinical letterhead is required. Intestinal parasites, Coccidiosis, Hypoglycemia, hernias, worms, Giardia, undescended testicles, inability to breed, inability to perform in any show(s) or entertainment, landlord’s approval, human allergies to animal, stress effects, family disagreements, skin issues, dermatitis, animal temperament, ear and/or yeast infections, size, color, coat type and/or bite quality are excluded herein.

I have read and understand the Animal Replacement Option listed below *

After the initial 72 hours, to exercise the animal-replacement option, Buyer must submit to Seller from licensed veterinarian any and all medical reports and diagnoses specifically stating said any and all life-threatening or debilitating illness(es). Said reports must indicate that the problem is 100% genetic and not caused by any environmental influences or situations. If the dog is found to have a life-threatening genetic condition, upon written proof thereof provided to the breeder, diagnosed by licensed veterinarian before the dog reaches (2) years old, the Breeder will pay the expenses of treatment recommended by a licensed veterinarian up to the purchase price of the dog. Breeder reserves the right to second opinion at the breeders expense by a licensed veterinarian. Buyer must also return all original paperwork received at time of animal delivery, or Seller is released from all responsibilities herein. Any replacement animal is 100% Seller’s choice from Seller’s available animals, if any. Within the 24 Month only agreement, should animal unexpectedly and immediately die from ‘unknown cause’ at that moment, a licensed veterinarian must perform a necropsy on said animal and a copy of said necropsy report to Seller before any determination of an animal replacement shall be made or agreed upon by Seller. Replacement is always at Seller’s sole discretion. No exceptions. All veterinarian and other expenses are always the sole responsibility of the Buyer, including shipping and handling costs, if any, and the replacement animal. Seller assumes no liability for any injury of any kind to animal after delivery to Buyer. All paperwork must be returned to Seller within 24 hours of necropsy. If paperwork is not returned within 24 hours, Seller is unconditionally and immediately released from health guarantee and all other terms and conditions herein. This Agreement is now void.Other Considerations: Color, mature weight, temperament, etc. cannot be guaranteed in any animal and are not guaranteed herein. However, Seller can make an educated guess for information purposes only based on animal’s parents’ physical characteristics and personality, as well as same from previous litters from a certain dam and sire combination. All puppies are sold as pet only without breeding rights unless other arrangements are made between Seller and Buyer for an additional fee and specifications herein. Buyer agrees to provide written proof of spay or neuter of the dog from a licensed veterinarian by the time the dog reaches 12 months old. Under no circumstances is buyer permitted to breed this dog without having purchased breeding rights from the breeder. Breeding this dog in violation of the terms of this agreement or violations of Spay/Neuter requirements the buyer understands and agrees that any violation shall entitle breeder to liquidation damages in the amount of $10,000.

The buyer has read and understand the transportation information below *

Seller extends and/or offers NO warranty whatever concerning any modes of transportation chosen by buyer for delivery to Buyer of animal from Seller. The animal is FOB Shipping Point, at which time Seller relinquishes all control and ownership to Buyer or Buyer’s Transportation Agency or Agent. This includes but is not limited to all injury or other malady, including stress from travel and any of its effect on animal. No other warranties expressed or implied are made or connected to this animal except specified herein. All health and other guarantees herein are rescinded by Seller is the animal has been bred by the Buyer. Any disputes shall be handled in Seller’s jurisdiction at a place of Seller’s choice. If all terms and conditions in this agreement herein are not met by Buyer, this agreement is immediately null, and void and Seller is fully and unconditionally released from this agreement.

I understand the *

Seller has first right of refusal and fit home requirement. Buyer will NOT offer the dog for sale, adoption, or other transfer of ownership or control, or euthanize the dog for a non-life-threatening illness or issue of any kind without first offering the dog back the breeder. The breeder will handle the rehome of the dog after vet check and/or training and will give the buyer the rehoming fee less the deposit and vet and or additional training fees.

to abide by all the above terms and conditions as the prerequisite to any puppy from Seller being delivered to Buyer, as well as after delivery of said puppy from Seller to Buyer.
